Following a Ministry of Justice consultation paper earlier this year on simplifying the Lasting of Attorney application forms, a statutory instrument has represcribed LPA (PFA) and LPA (HW) and created several continuation sheets to be used in conjunction with both LPA(PFA) and LPA(HW)
· LPA IS is an Information Sheet to help people complete both LPA(PFA) and LPA(HW).
· LPA A1 can be used with either form to provide details of all additional attorneys, replacement attorneys or people to be informed about the creation of the LPA.
· LPA A2 can be used with either form to instruct the attorney how the donor wants the attorney to act on his or her behalf.
· LPA A3: PFA can only be used with LPA(PFA) where the donor is unable to sign or make a mark on LPA(PFA).
· LPA A3: HW can only be used with LPA(HW) where the donor is unable to sign or make a mark on LPA(HW).
· LPA B can be used with either form as a declaration by the provider of a second certificate that the donor understands the significance of creating the LPA.
· LPA C can be used with either form to appoint a trust corporation as attorney or a replacement attorney.
CURRENT VERSIONS OF LPA(PFA) AND LPA (HW) SHOULD NOT BE USED AFTER 1ST OCTOBER. AMENDED EDITIONS OF LPA (PFA), LPA (HW) AND ALL THE NEW CONTINUATION SHEETS WILL BE AVAILABLE BY THE END OF SEPTEMBER
