AMENDED COURT OF PROTECTION FORMS

The Office of the Public Guardian has amended the contact details for the Court Enquiry Service and inserted new and amended website addresses on the Court of Protection forms listed below. 
 
• COP 1 is used to start proceedings and specifies the required order. 
• COP 1A and COP 1B can be used in support of this initial application. 
• COP 2 is filed with the court at the same time as COP1. 
• COP 3 is filed with the court with COP1, but is not required where the application relates to an enduring power or lasting power of attorney. 
• COP 4 is filed with COP 1 and is used when the applicant is asking the court to appoint a deputy. 
• People who receive COP 1 and who want to take part in proceedings must file COP 5 with the court. 
• COP 7 is used to object to the registration of a LPA and COP 8 is used to object to the registration of an EPA. 
• COP 9 is used for certain types of applications whilst COP 10 is used to join proceedings. 
• COP 14 explains to a person the nature of the proceedings affecting them and COP 15 notifies interested third parties that proceedings are underway. 
• COP 20 must be filed with the court to confirm that a document has been served or notification provided. 
• COP 35 is used where a person wishes to appeal against a decision of the court and COP 36 is used by respondents in an appeal. 
 
PRACTITIONERS SHOULD CHECK WITH THE COURT OF PROTECTION WHETHER THEY WILL CONTINUE TO ACCEPT EXISTING FORMS. AMENDED FORMS WILL BE AVAILABLE TOWARDS THE END OF MAY.
