Commonhold and Leasehold Reform Act 2002

A second Commencement Order has introduced a new right for long leaseholders of flats to manage their building(s) in England under the provisions of the Commonhold and Leasehold Reform Act 2002 on 30th September. 
 
•Certain Regulations have prescribed the memorandum of association and articles of association of companies which will be formed under Chapter 1, Part 2 of the 2002 Act to manage property on behalf of qualifying tenants (called an 'RTM Company') 
 
•Different Regulations have prescribed the content of RTM 1, RTM 2 and RTM 3 
 
•RTM 1 is the notice which RTM companies must give to qualifying tenants, notifying them of the RTM Company’s intention to acquire the right to manage the premises 
 
•RTM 2 is a claim by the RTM Company to acquire the right to manage the premises which is served on a landlord, any party to a lease and any current manager of the premises 
 
•RTM 3 is a response to RTM 2 by a person who either admits or opposes the claim by the RTM Company 
 
•RTM 4 is a notice which is served by the existing manager of premises (normally either the landlord or management company appointed under the lease) on the RTM Company 
 
•RTM 5 is similar to RTM 4 but is used by the existing manager of premises to disclose details of contracts concerning the premises 
 
Separate Regulations will come into force on 31st October in England concerning tenants’ contributions to service charges demanded by their landlords. We have published the three forms below to assist practitioners with these Regulations. 
 
•L&T200 is a notice served by a landlord upon either a tenant or tenants’ association of the landlord’s intention to enter into a long-term agreement 
 
•L&T201 is a landlord’s notice served upon either a tenant or tenants’ association of the landlord’s intention to carry out works conducted under a long-term agreement 
 
•L&T 202 is similar to L&T201 but is used where works are not covered under a long term agreement 
 
THESE NEW FORMS WILL BE AVAILABLE TOWARDS THE END OF SEPTEMBER. RTM1A, RTM1, RTM2, RTM3, RTM4 and RTM5 CANNOT BE USED BEFORE 30TH SEPTEMBER. L&T 200, L&T 201 AND L&T 202 CANNOT BE USED BEFORE 31ST OCTOBER. 
 
The relevant Statutory Instruments will come into force in England on 30th September Information and 31st October 2003.
