Certain Rules prescribe the new Land Registry forms of application for commonhold under the provisions of the Commonhold and Leasehold Reform Act 2002. Practitioners can obtain Practice Guide No. 60 from the Land Registry about these new procedures.
• CM1 must be used when applying to register a freehold estate in commonhold land.
CM1 must be accompanied by the COV form below and a statutory declaration that certain consents have been given in form CON1.
•CM2 is used to notify the Land Registry that the land which is registered as a freehold estate in commonhold land has ceased to be commonhold during the transitional period.
CON 2 is normally lodged with CM2 at the Land Registry.
•CM3 is used to register details of an amended commonhold community statement and/or amended memorandum and articles of association and is lodged with the COE form below.
•CM4 is used to add land to a freehold estate in commonhold and must be accompanied by CM3 and in certain circumstances, the COE form below.
•CM5 is used to terminate a commonhold registration where a court has made a winding-up order in respect of a commonhold association.
•CM6 must be used to notify the Land Registry of the existence of a successor commonhold association.
•COE is used to notify the Land Registry of a change to the commonhold land where it is subject to a mortgage or legal charge. It must accompany CM3 and on occasions, CM4.
•CON 1 is used to provide consent to registration of commonhold land and is used with CM1.
•CON 2 is a form of consent which is used in conjunction with CM2.
•COV accompanies CM1 because it lists the unit-holders of commonhold land.
•SR1 is used to notify the Land Registry of a surrender of development rights in relation to the commonhold land.
