The Licensing Act 2003 - New Forms

Certain Regulations have prescribed new forms for use under the Licensing Act 2003. 
 
•The Licensing Act 2003 received Royal Assent in July 2003 and replaces the existing system for licensing clubs, public houses, theatres, cafés and restaurants. 
 
•The 2003 Act requires licensing authorities to licence the sale and supply of alcohol and to maintain a register recording detailed information about these establishments. 
 
•From the first appointed day under the 2003 Act, transitional provisions enable licensing authorities to receive applications for premises licences, club premises certificates and provisional statements, as well as process applications for the conversion of existing licences and club certificates and vary new licences and certificates under section 8 of the 2003 Act. 
 
•Some of the new Regulations require certain applications to be advertised and publicly displayed on the exterior of the premises. We have therefore drafted Licensing forms 6, 8, 10, 17 and 19 to advertise different types of licensing applications which in certain circumstances can also be displayed publicly outside the premises. 
 
•Practitioners are advised that the transitional period between the first and second appointed days under the 2003 Act means that existing forms under the Licensing Act 1964 may continue to be submitted but that they will not be accepted when the second appointed day is confirmed by subsequent regulations, later this year. 
 
The first appointed day under the Licensing Act 2003 was 7th February 2005. The second appointed day will be determined by the Department for Culture, Media and Sport, but is provisionally scheduled for November 2005. 
 
EXISTING LICENSING FORMS 1-20 MAY CONTINUE TO BE USED UNTIL THE SECOND APPOINTED DAY IS CONFIRMED BY THE GOVERNMENT LATER THIS YEAR. THE NEW LICENCING FORMS WILL BE AVAILABLE TOWARDS THE END OF APRIL.
