Residential and Business Leases

Schedule 1A of the Land Registration (Amendment No. 2) Rules 2005 prescribes specified information which must be included in certain registrable leases granted on or after 19th June 2006. Practitioners can obtain more detailed information on these changes in the Land Registry’s Practice Guide Number 64 which was published in September 2005. 
 
We have adapted our existing forms for practitioners to use in conjunction with the Land Registry’s requirements. 
 
·Con 23 is a new form which can be used to create a lease of residential property for a term exceeding seven years. 
·Con 24 is a new form for a lease of business premises where the lease exceeds a term of seven years or more. 
 
PRACTITIONERS SHOULD NOT USE CURRENT OYEZ FORMS CON 23, CON 23A, CON 23B, CON 24A AND CON 25 ON OR AFTER 19TH JUNE. CON 26 AND CON 26A MAY CONTINUE TO BE USED PROVIDED THE PERIOD DOES NOT EXCEED SEVEN YEARS. THE AMENDED VERSIONS OF CON 23 AND CON 24 WILL BE AVAILABLE IN JUNE AND MUST BE USED ON OR AFTER 19TH JUNE.
