This is a general form for letting any type of property
1. Agreement 1 is a general form of letting for use in situations where our other tenancy agreement forms are not appropriate. This form can be used for both residential and commercial purposes and will either form an assured shorthold tenancy or an ordinary contractual tenancy. The type of tenancy created depends on the surrounding circumstances and the Housing Act 1988, to which special rules for recovering possession apply. Those rules are set out in the Housing Act 1988 as amended by the Housing Act 1996.
2. Since 28th February 1997 most lettings of residential property to an individual have created an AST if the property is let as a separate dwelling.
3. A Contractual Tenancy Agreement may be used in any of the following tenancy situations where an assured shorthold tenancy should not be used:
(a) where the rent is to be greater than £100,000 per annum;
(b) where the tenant is not an individual (e.g. company let)
(c) where the premises being let is self-contained accommodation in a property; that has been converted from a single property to multiple units (e.g. a house converted into flats), where the landlord lives;
(d) where the property is not the tenant’s only or principal home (but not a holiday let).
4. This form should only be used when one of our other tenancy agreements will not suffice:
